| 520 | |a This is a manuscript of a Pfersee Beth Din (rabbinical court) ruling between the parnassim and the wealthy lay members of the Binswangen community, who were disputing the manner in which taxes and dues were collected for the communal treasury and a case of raising taxes on individuals (an archival note on document dorse identifies the leader of the lay party as Mendel Binswanger; f. 2v). The Oberrabinner ruled that in every forthcoming case of disputes between factions, there must be a third party arbitrator; the arbitrator in cases which are unable to reach verdict in Binswangen must be arbitrated or presided over by the Pfersee rabbinate (the position of Oberrabinner extended to all areas under Schwabach) who will also use this position to prevent acrimonious or unlawful usurpation by the parnassim. The verdict for the case at hand is written in Yiddish (likely to be understood by all) and, ruling against the parnassim, it is deemed unlawful and against the earlier rulings written in the pinkas (likely the Pfersee-Augsburg community pinkas) to raise any individual's taxes above a sixth (of the original sum) to close any deficit or need for an expense.
